LONG TITLE

AN ACT to amend the Road Fund Act, 1997 (Act 536) to establish the Road Fund as a body corporate; and to provide for related matters.

ACT

1. Section 1 of Act 536 amended

1. The Road Fund Act, 1997 (Act 536) referred to in this Act as the "principal enactment" is amended by the substitution for section 1 of

"1. Establishment of the Road Fund

(1) There is established by this Act a fund to be known as the Road Fund.

(2) The Fund is a body corporate with perpetual succession and a common seal, may sue and be sued and shall have in all respects the powers of a body corporate.".

2. Section 3 of Act 536 amended

The principal enactment is amended in section 3

(a) by the deletion in paragraph (d) of "and" at the end of paragraph (d); and

(b) by the insertion after paragraph (d) of a new paragraph (da)

"(da) moneys borrowed and raised on its own from banks and any other financial institution, determined by the Fund in consultation with the Minister responsible for Finance, and;"

3. Section 5 of Act 536 amended

(1) The principal enactment is amended in subsection (2) of section 5 by the

(a) deletion of paragraph (a);

(b) substitution for

(i) paragraph (b) of

"(b) one representative of the Ministry of Finance not below the rank of a Director;"

(ii) paragraph (c) of

"(c) one representative of the Ministry of Power not below the rank of a Director;"

(iii) paragraph (e) of

"(e) one representative of the Ministry of Local Government and Rural Development not below the rank of a Director,"; and

(iv) subparagraph (ii) of paragraph (g) of

"(ii) one representative of the Co-ordinating Council of the Ghana Road Transport Association;";

(c) deletion of subparagraph (iv) of paragraph (g); and

(d) insertion of a new paragraph (h) as follows:

"(h) one independent person with expertise in road and transport nominated by the President.".

(2) The principal enactment is amended in section 5 by the insertion of a new subsection (3) as follows

"(3) The President shall appoint a chairperson for the Board." .

4. Section 6 of Act 536 amended

The principal enactment is amended in section 6 by the substitution for subsection (1) of

"(1) The Fund shall be managed by the Board.".

5. Section 16 of Act 536 amended

The principal enactment is amended in subsection (1) of section 16 by the substitution for "management" of "administration".

6. Section 18A inserted

The principal enactment is amended by the insertion after section 18 of new section 18A

"18A. Regulations

The Minister may, by legislative instrument, make Regulations for the effective implementation of this Act.".
