PURPOSE
AN ACT to amend the Bui Power Authority Act, 2007 (Act 740) to provide for the Authority to develop renewable energy and other clean energy alternatives in the country and for related matters.

ACT
1. Long Title of Act 740 amended
The Bui Power Authority Act, 2007 (Act 740), referred to in this Act as the "principal enactment", is amended in the Long Title by the substitution for the Long Title, of
- "AN ACT to establish the Bui Power Authority to develop hydroelectric power on the Black Volta River at Bui and other potential hydroelectric power sites on the Black Volta River and any other river determined by the State; to develop renewable energy and any other clean energy alternatives in the country and provide for related matters.".
2. Section 11 of Act 740 amended
The principal enactment is amended in section 11 by
- (a) the substitution for subparagraph (iii) of paragraph (c) of subsection (1), of
- "(iii) any other consumer in Ghana or elsewhere under an arrangement agreed on between the Government, the Authority and a consumer, and":
- (b) the insertion after subsection (1) of
- "(1A) The Authority shall, in accordance with the Renewable Energy Act, 2011 (Act 832)
- (a) execute, on behalf of the State, renewable energy projects assigned to the Authority by the Minister;
- (b) manage, on behalf of the State, the assets in the renewable energy sector assigned to the Authority by the Minister; and
- (c) undertake renewable energy activities and any other clean energy alternative activities for the purpose" of generating electric power."; and
- "(1A) The Authority shall, in accordance with the Renewable Energy Act, 2011 (Act 832)
- (c) the substitution for paragraph (a) of subsection (2) of
- "(a) carry on an activity which is reasonably required, or assigned to the Authority by the Minister, or in connection with the performance of the functions of the Authority under this Act; and".
3. Section 30 of Act 740 amended
The principal enactment is amended in section 30 by the insertion after the definition for "citizen", of
- ""clean energy alternatives" includes nuclear energy;".
