PURPOSE
AN ACT to amend the Statutory Instruments Act, 1959 (No. 52) of 1959 to increase the penalty that may be imposed in statutory instruments.

Section 1 — Section 9 of Statutory Instruments Act, 1959 amended
The Statutory Instruments Act, 1959 (No. 52) of 1959 as amended is further amended by the repeal of section 9 and the insertion of the following:
- "9 Penalties
- (1) There may be included in a statutory instrument which contains a prohibition or requirement, a provision that a person who fails to comply with that prohibition or requirement is liable to penalties.
- (2) A penalty prescribed for an offence by virtue of this section, shall be not more than a fine of one hundred and fifty penalty units or imprisonment for a term of one year or both and in the case of a continuing offence, an additional penalty of not more than five penalty units may be prescribed by the instrument for each day on which the offence continues.
Section 2 — Repeal
The Statutory Instruments (Amendment) Act, 1997 (Act 539) is hereby repealed.
